Terms of Service

1. Introduction

These Terms of Service (”Terms”) govern your access to and use of the Jolipop website, mobile applications and educational services (collectively, the “Services”).

These Terms constitute a legally binding agreement between you and Jolipop.

By creating a Jolipop account, purchasing a subscription or otherwise accessing or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

2. About Jolipop

Jolipop is an educational technology platform designed to support English language learning for children through parent-managed family accounts.

The Services may include, among other things:

• educational lessons;
• interactive learning activities;
• personalised educational recommendations;
• learning progress tracking;
• subscription-based premium features;
• educational content and updates.

The Services are provided for educational purposes only.

Unless explicitly stated otherwise, Jolipop does not provide accredited educational qualifications, professional educational advice or guarantees regarding individual learning outcomes.

3. Eligibility

To create a Jolipop account, you must:

• have legal capacity to enter into a binding agreement under the laws applicable to you;
• act as a parent or legal guardian, or otherwise be authorised to create and manage an account for the child using the Services;
• provide accurate and complete registration information.

By creating an account, you represent and warrant that these requirements are satisfied.

4. Family Accounts

Jolipop is designed around family-managed accounts.

The contractual relationship established under these Terms exists between Jolipop and the parent or legal guardian who creates the account.

Children do not independently create Jolipop accounts or enter into contractual relationships with Jolipop.

Parents remain responsible for managing the family account and supervising children’s use of the Services.

5. Acceptance on Behalf of Children

Where you create or manage a child profile, you confirm that you are authorised to act on behalf of that child regarding the use of the Services.

You are responsible for ensuring that the child’s use of Jolipop is appropriate in light of the child’s age, maturity and individual circumstances.

Nothing in these Terms transfers parental responsibilities from the parent or legal guardian to Jolipop.

6. Changes to These Terms

We may update these Terms from time to time.

Changes may become necessary for reasons including:

• changes to applicable laws;
• introduction of new Services;
• improvements to existing functionality;
• security enhancements;
• operational or business developments.

Where changes materially affect your rights or obligations, we will provide reasonable notice before the updated Terms become effective where practicable.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of those changes.

These Terms should be read together with the documents that govern other aspects of your relationship with Jolipop.

Where a conflict exists between these Terms and another document, the document specifically addressing the relevant subject matter will prevail to the extent of that conflict.

8. Changes to the Services

Jolipop continuously develops and improves its Services.

Accordingly, we may:

• add new features;
• modify existing functionality;
• improve educational content;
• enhance accessibility;
• strengthen security;
• update technical infrastructure.

We aim to minimise disruption whenever changes are made.

Nothing in these Terms obliges Jolipop to maintain any specific feature indefinitely.

9. Availability

We use reasonable efforts to provide reliable access to the Services.

However, uninterrupted availability cannot be guaranteed.

The Services may occasionally become unavailable due to:

• scheduled maintenance;
• emergency maintenance;
• software updates;
• infrastructure failures;
• security incidents;
• telecommunications failures;
• events beyond our reasonable control.

Where reasonably practicable, scheduled maintenance will be performed in a manner intended to minimise disruption.

10. Electronic Communications

By creating a Jolipop account, you agree that Jolipop may communicate with you electronically where permitted by applicable law.

Such communications may include:

• account notifications;
• security alerts;
• subscription information;
• service announcements;
• legally required notices;
• responses to support requests.

Electronic communications satisfy any legal requirement that communications be provided in writing, unless applicable law requires otherwise.

11. Definitions

For the purposes of these Terms:

“Account” means the parent-managed Jolipop account used to access the Services.

“Child Profile” means an educational profile created within a family account for a child.

“Content” means educational materials, software, text, graphics, audio, video and other materials made available through the Services.

“Services” means the Jolipop websites, applications and related educational services.

“Subscription” means any paid plan providing access to premium Services.

“You” means the parent, legal guardian or other authorised person entering into these Terms with Jolipop.

12. Interpretation

Unless the context requires otherwise:

• headings are provided for convenience only;
• references to the singular include the plural and vice versa;
• references to legislation include amendments and successor legislation where applicable;
• references to “including” or similar expressions mean “including without limitation.”

13. Account Registration

To access certain Services, you must create a Jolipop Account.

When registering an Account, you agree to:

• provide accurate, current and complete information;
• maintain the accuracy of your account information;
• keep your login credentials confidential;
• promptly notify Jolipop of any suspected unauthorised access or security incident affecting your Account.

You are responsible for all activities occurring under your Account unless such activities result from a security incident attributable to Jolipop.

Jolipop reserves the right to suspend or terminate Accounts containing materially inaccurate information or created in violation of these Terms.

14. Account Security

You are responsible for maintaining the confidentiality of your authentication credentials.

You must not:

• share your password with unauthorised persons;
• intentionally allow others to access your Account;
• circumvent authentication mechanisms;
• attempt to gain access to another user’s Account.

Jolipop implements technical and organisational security measures designed to protect user Accounts. However, no online service can guarantee absolute security.

Where you believe your Account has been compromised, you must notify Jolipop without undue delay.

15. Child Profiles

Parents may create one or more Child Profiles within their family Account.

Each Child Profile exists solely to support the educational experience of the relevant child.

Parents remain responsible for:

• creating Child Profiles;
• managing Child Profile information;
• supervising children’s use of the Services;
• requesting correction or deletion of Child Profile information where appropriate.

Children do not independently administer Child Profiles.

16. Acceptable Use

You agree to use the Services only in accordance with these Terms and applicable law.

You must not:

• use the Services for unlawful purposes;
• interfere with the operation or security of the Services;
• attempt to access systems or information without authorisation;
• introduce malicious software or harmful code;
• use automated tools to access the Services except where expressly authorised;
• impersonate another individual or organisation;
• provide false or misleading information;
• use the Services in a manner that could damage, disable or impair Jolipop or other users.

You remain responsible for all activity conducted through your Account.

17. Educational Use

Jolipop is intended to support education.

Accordingly, you agree not to use the Services for purposes unrelated to legitimate educational use.

The Services must not be used to:

• distribute unlawful material;
• infringe the rights of others;
• harass or abuse other individuals;
• transmit malicious software;
• conduct commercial activities unrelated to Jolipop;
• misuse educational content.

Jolipop reserves the right to investigate suspected misuse of the Services.

18. User Content

Certain Services may allow parents to submit information, feedback or other content.

You retain ownership of content that you lawfully submit.

By submitting content to Jolipop, you grant Jolipop a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and process that content solely to the extent necessary to operate, maintain and improve the Services.

You represent and warrant that:

• you have the necessary rights to submit the content;
• the content does not infringe the rights of third parties;
• the content does not violate applicable law.

Jolipop does not claim ownership of your content.

19. Educational Content

All educational content made available through the Services is provided for personal educational use.

Unless expressly permitted by applicable law or by Jolipop in writing, you must not:

• copy educational materials for commercial purposes;
• redistribute educational content;
• sell or sublicense educational materials;
• create competing commercial products using Jolipop content.

Reasonable personal educational use by members of your family is permitted.

20. Intellectual Property

Unless otherwise indicated, the Services and all associated intellectual property rights are owned by Jolipop or its licensors.

This includes, without limitation:

• software;
• educational content;
• graphics;
• designs;
• trademarks;
• logos;
• documentation;
• audiovisual materials;
• databases.

Nothing in these Terms transfers ownership of Jolipop’s intellectual property to you.

Subject to these Terms, Jolipop grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for their intended purpose.

21. Feedback

We welcome suggestions for improving Jolipop.

If you voluntarily provide feedback, ideas or recommendations, you agree that Jolipop may use those suggestions without restriction or obligation to compensate you.

This provision does not affect your rights regarding personal information, which remain governed by our Privacy Policy.

22. Beta Features

From time to time, Jolipop may make experimental or beta features available.

Beta features:

• may contain defects;
• may change substantially before general release;
• may be discontinued without notice;
• may be subject to additional terms.

Unless otherwise stated, beta features are provided for evaluation purposes and should not be relied upon for critical educational activities.

23. Suspension of Access

Jolipop may suspend or restrict access to the Services where reasonably necessary to:

• protect the security of the platform;
• investigate suspected violations of these Terms;
• comply with legal obligations;
• prevent fraud or abuse;
• protect other users;
• maintain system integrity.

Where appropriate and reasonably practicable, Jolipop will provide notice of a suspension and an opportunity to resolve the issue before terminating access.

Immediate suspension may occur where necessary to protect the Services, users or Jolipop from imminent harm.

24. Subscriptions

Certain Services are available only through a paid Subscription.

Subscription plans, pricing and available features are described at the time of purchase.

Subscriptions are governed by these Terms together with the applicable Subscription Terms.

By purchasing a Subscription, you agree to pay all applicable fees associated with your selected plan.

25. Billing and Payment

Payments are processed by authorised third-party payment providers.

Jolipop does not store complete payment card information.

By purchasing a Subscription, you authorise the applicable payment provider to charge the payment method associated with your purchase in accordance with your selected Subscription.

Applicable taxes may be added where required by law.

26. Renewals

Unless otherwise stated at the time of purchase, Subscriptions automatically renew at the end of each billing period.

You may cancel automatic renewal at any time through the relevant account settings or the applicable payment platform.

Cancellation prevents future renewals but does not automatically entitle you to a refund for the current billing period unless required by applicable law or our Subscription Terms.

27. Price Changes

Jolipop may modify Subscription prices from time to time.

Price changes will not apply retroactively.

Where required by applicable law or by the applicable payment platform, reasonable advance notice will be provided before a new price becomes effective.

If you do not agree to a price change, you may cancel your Subscription before the next renewal date.

28. Free Trials

Jolipop may offer free trials or promotional access to certain Services.

Unless otherwise stated:

• free trials are available only for the specified promotional period;
• eligibility requirements may apply;
• Jolipop may modify or discontinue promotional offers at any time;
• additional terms may apply to specific promotions.

Where a free trial converts into a paid Subscription, the applicable payment terms presented during registration shall apply.

29. Cancellation

You may cancel your Subscription at any time.

Cancellation affects future billing only.

Unless otherwise required by law or expressly stated in the applicable Subscription Terms, cancellation does not result in a refund for any unused portion of the current Subscription period.

Cancellation of a Subscription does not automatically delete your Jolipop Account.

Account deletion is governed separately by our Privacy Policy and applicable legal requirements.

30. Termination

You may stop using the Services at any time.

Jolipop may suspend or terminate access where:

• these Terms are materially violated;
• continued access presents a security risk;
• fraudulent or unlawful activity is reasonably suspected;
• continued provision of the Services becomes unlawful;
• termination is otherwise permitted under these Terms or applicable law.

Where circumstances permit, Jolipop will provide reasonable notice before termination.

Immediate termination may occur where necessary to protect users, the Services or Jolipop.

Termination does not affect rights or obligations that accrued prior to termination.

31. Effect of Termination

Following termination:

• your right to access the Services ends;
• active Subscriptions terminate in accordance with the applicable Subscription Terms;
• Jolipop may disable access to your Account;
• personal information will continue to be handled in accordance with our Privacy Policy;
• provisions intended to survive termination remain effective.

Examples of surviving provisions include intellectual property rights, limitation of liability, indemnification, dispute resolution and provisions relating to applicable law.

32. Educational Disclaimer

Jolipop is designed to support English language learning.

Educational progress depends upon many factors beyond Jolipop’s control, including:

• learner engagement;
• consistency of practice;
• parental involvement;
• prior educational experience;
• individual learning differences.

Accordingly, Jolipop does not guarantee any particular educational outcome, examination result, language proficiency level or rate of learning.

The Services are intended to support learning and should not be interpreted as a substitute for professional educational advice where such advice is required.

33. Warranty Disclaimer

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.”

Except as expressly stated in these Terms or where prohibited by law, Jolipop disclaims all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms excludes warranties that cannot legally be excluded under applicable law.

34. Limitation of Liability

To the maximum extent permitted by applicable law, Jolipop shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to the use of the Services.

This includes, without limitation, loss of profits, loss of revenue, loss of goodwill, business interruption, loss of data or other intangible losses.

Where liability cannot be excluded under applicable law, Jolipop’s liability shall be limited to the maximum extent permitted by that law.

Where permitted by applicable law, Jolipop’s aggregate liability arising out of or relating to the Services shall not exceed the total amount paid by you to Jolipop for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, gross negligence or any liability that cannot lawfully be limited or excluded.

35. Indemnification

You agree to indemnify and hold harmless Jolipop, its directors, officers, employees and affiliates from claims, liabilities, damages, losses and reasonable expenses arising from:

• your breach of these Terms;
• your unlawful use of the Services;
• infringement of third-party rights resulting from your actions;
• content submitted by you in violation of these Terms.

This obligation applies only to the extent permitted by applicable law.

36. Force Majeure

Jolipop shall not be liable for delays or failures to perform resulting from circumstances beyond its reasonable control.

Such circumstances may include, without limitation:

• natural disasters;
• acts of government;
• war;
• terrorism;
• labour disputes;
• widespread internet or telecommunications failures;
• cyberattacks by third parties;
• failures of critical infrastructure;
• other unforeseeable events beyond reasonable control.

Jolipop will use reasonable efforts to resume normal operation as soon as practicable.

37. Governing Law

These Terms shall be governed by and construed in accordance with the laws specified in the applicable Subscription Terms or, where no such provision applies, the laws governing Jolipop’s principal place of business, excluding conflict-of-law principles to the extent permitted by applicable law.

Nothing in this section limits mandatory consumer protection rights that apply under the laws of your country of residence.

38. Dispute Resolution

Before commencing formal legal proceedings, the parties agree to make reasonable efforts to resolve disputes through good-faith discussions.

If a dispute cannot be resolved informally, either party may pursue the remedies available under applicable law.

Nothing in these Terms limits any rights that consumers may have under mandatory consumer protection legislation.

39. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall, where possible, be interpreted or replaced in a manner that most closely reflects its original purpose while remaining legally enforceable.

40. No Waiver

Failure by Jolipop to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights available under these Terms or applicable law.

Any waiver must be made expressly and in writing.

41. Entire Agreement

These Terms, together with the documents expressly incorporated by reference, constitute the entire agreement between you and Jolipop regarding the Services.

They supersede all prior agreements, understandings and representations relating to the same subject matter.
